Notice of Public Hearing to Adopt Rules

A public hearing will be held at the Drifters Event Center, 325 Hustan Ave., Ft. Pierre, SD, on May 31, 2024, at 10:00 a.m. Central/9:00 a.m. Mountain, to consider the adoption and amendment of proposed Administrative Rules of South Dakota numbered:

§§ 20:43:10:02; 20:43:10:03

The effect of the rules will be to update the collaborative supervision administrative rules and remove a clinical practice requirement to make the collaborative supervision administrative rules consistent with HB 1074.    

The reason for adopting these rules is to make the collaborative supervision administrative rules consistent with statutory changes passed during the 2024 legislative session (HB 1074).

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing, by mailing them to the South Dakota State Board of Dentistry, PO Box 1079, Pierre, South Dakota, 57501, by emailing contactus@sdboardofdentistry.com.  Written comments must reach the Board of Dentistry office on or before May 24, 2024 to be considered. 

After the written comment period, the Board of Dentistry will consider all written and oral comments it receives on the proposed rules.  The Board of Dentistry may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.

As part of the rule promulgation process, the Legislative Research Council (LRC) is conducting a review of the draft rules.  LRC form and style revisions will be posted when those are available. 

When reviewing the draft, please note that anything with an overstrike is currently in rule and being proposed for deletion.  Anything with an underline is not currently in rule and is being proposed as an addition.  Other text is currently in rule and is not being changed.
