Notice of Public Hearing to Adopt Rules

A public hearing will be held at the Drifters Event Center, 325 Hustan Ave., Ft. Pierre, SD, on February 9, 2024, at 10:00 a.m. Central/9:00 a.m. Mountain, to consider the adoption and amendment of proposed Administrative Rules of South Dakota numbered:

§§ 20:43:11:01; 20:43:11:02; 20:43:11:03; 20:43:11:04

The effect of the rules will be to address maintenance, timelines, transfer, and destruction of records maintained by dentists and dental entities. 

The reason for adopting these rules is to provide clarity for practitioners and the public regarding maintenance, timelines, transfer, and destruction of records maintained by dentists and dental entities, as requested by stakeholders.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing, by mailing them to the South Dakota State Board of Dentistry, PO Box 1079, Pierre, South Dakota, 57501, by emailing contactus@sdboardofdentistry.com.  Written comments must reach the Board of Dentistry office on or before February 5, 2024 to be considered. 

After the written comment period, the Board of Dentistry will consider all written and oral comments it receives on the proposed rules.  The Board of Dentistry may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
