Advertising/Specialty Advertising and Clinical Competency Examination Draft Administrative Rules11/10/2022
Earlier this year, the Board worked with its general counsel to release an initial draft of the advertising/specialty advertising administrative rules that incorporated the use of disclaimers, based on regulatory models found in other states and legal precedent in this area. The Board solicited stakeholder feedback on the initial draft of these administrative rules and reviewed that feedback at its meeting on June 24, 2022. Based on feedback received and a review by general counsel, the Board voted at its June 24, 2022 meeting to release a second draft of the administrative rules that incorporates a two-year full-time residency requirement and to solicit stakeholder feedback. A second draft of the administrative rules was subsequently released, stakeholder feedback on the draft was solicited, and stakeholder feedback was reviewed at the October board meeting.
In an effort to ensure ample opportunity for stakeholders to submit feedback, the Board is reopening the online stakeholder feedback portal for the draft rules released this fall (two-year full-time residency requirement). For those that submitted feedback prior to the October meeting, that feedback has been received and reviewed. For those that have not yet submitted feedback, or have additional feedback to share, please submit feedback using the online stakeholder feedback portal. All feedback must be submitted by 5pm Central on December 12, 2022. Following that date, the feedback will be reviewed and the draft may be modified accordingly. When reviewing the draft updates, please note that anything with an
overstrike is currently in rule and being proposed for deletion. Anything with an underline is not currently in rule and is being proposed as an addition. Other text is currently in rule and is not being changed.
